After arriving at Miami International Airport (MIA) and collecting your luggage from the baggage claim area, please follow the steps below:
Proceed to the 3rd floor, following the signs for the MIA Mover.
Take the escalators to the MIA Mover station.
Board the MIA Mover train, which will take you to the Rental Car Center.
Upon arrival at the Rental Car Center, proceed to the outer shuttle platforms.
A NEXTCAR shuttle bus will be available approximately every 15 minutes at platforms 1 or 2 and will transport you to our rental location.

Drop off instructions
The rental vehicle must be returned at the time and location expressly stipulated in the Rental Agreement, as agreed between the customer and the Facility Rent a Car representative.
Failure to comply with the agreed return time or return location may result in additional charges, including but not limited to extension fees, towing, recovery, administrative fees, and Loss of Use, where applicable.
Late Returns
A grace period of up to one (1) hour may apply at Facility’s discretion.
If the vehicle is returned more than one (1) hour after the scheduled return time, the rental will be considered extended for an additional full day, and the customer will be charged the daily rate in effect at the time of the extension, which may be higher than the original rate.
Early Returns
If the vehicle is returned before the return date and time stipulated in the Rental Agreement, no refund will be issued for unused rental days or prepaid amounts.
Different Drop-Off Location
Drop-offs at a location different from the original return location are available by request only, subject to approval and an additional fee.
Unauthorized returns to a different location may result in additional recovery and administrative charges.
By returning the vehicle, the customer authorizes Facility Rent a Car, LLC to process any applicable charges using the payment method on file, including after the conclusion of the rental.
Driver requirements
- Minimum rental age is 21 years.
- A young driver fee applies to drivers under the age of 25.
- Maximum rental age is 75 years.
- A senior driver fee applies to drivers over the age of 69.
- A young driver surcharge of USD 20,00 per day will apply to drivers aged from 21 years to 25 years.
- A senior driver surcharge of USD 20,00 per day will apply to drivers aged from 69 years to 75 years.
- The driver license must have been issued by authorized authorities at least 1 year(s) before the date of the commencement of the rental.
- Driver licenses from all other countries must be accompanied with an International Driving Permit (IDP).
- Please note that the International Driving Permit is valid only if accompanied by the regular driver license.
- In order to pick up the car, the following documents are required: passport, valid driver license, credit card on a main drivers name, and a booking voucher.
Insurance Coverage
Insurance Not Included
The following types of insurance are NOT included in the rental rate unless expressly purchased or otherwise provided by law:
Supplemental Liability Insurance (SLI)
Collision Damage Waiver (CDW)
Third-Party Liability (TPL)
If the renter does not qualify to use their own insurance, the renter must purchase TPL and/or CDW for an additional fee at the counter.
Using the Renter’s Own Insurance
To use their own insurance policy, the renter must present valid proof of coverage meeting all of the following requirements:

Insurance issued outside the United States is not accepted.
Coverage Requirements
The renter’s insurance must include both:
Third-Party Liability (TPL); and
Collision / Comprehensive coverage (CDW-equivalent)
With the following minimum terms:
Personal Injury Liability: minimum USD 500,000
Property Damage Liability: minimum USD 500,000
Maximum deductible: USD 500.00
Proof of Insurance Requirements
Acceptable proof of insurance must include all of the following:
Insurance declarations (policy) page;
Policy valid for at least 3 months prior to the pickup date;
Exact same name and residential address as shown on the renter’s driver’s license;
Coverage clearly listing liability and collision/comprehensive;
A valid insurance identification card matching the above information.
Failure to meet any of these requirements will result in the renter being required to purchase TPL and/or CDW at the counter.
Collision Damage Waiver (CDW)
CDW reduces the renter’s financial responsibility for physical damage to the rental vehicle resulting from an accident or collision, subject to a deductible, unless a zero-deductible option is purchased.
CDW Does NOT Cover:
Gross negligence or reckless conduct;
Intentional damage;
Any violation of the rental agreement;
Incorrect fueling or vehicle misuse;
Mechanical damage;
Towing services;
Loss of keys or key fobs;
Tires, wheels, glass, or interior damage;
Natural disasters;
Loss of Use;
Administrative Fees.
Theft Protection (TP)
Theft Protection covers the replacement of the vehicle in the event of theft, subject to a deductible.
TP Does NOT Cover:
Towing services;
Loss of keys or key fobs;
Tires, wheels, glass, or interior damage;
Natural disasters;
Administrative Fees;
Loss of Use.
TP coverage is only valid if the renter strictly complies with the rental agreement, including but not limited to:
Not leaving the vehicle unlocked;
Not leaving keys or key fobs inside the vehicle;
Prompt police reporting.
Failure to comply may result in full liability, not limited to the deductible.
WAVE Complementary Insurance
WAVE Complementary Insurance is NOT vehicle damage coverage.
WAVE applies only to third-party liability claims when:
The renter has no third-party liability insurance; or
The renter’s existing liability coverage is below USD 500,000, the minimum required by Facility.
WAVE Does NOT Cover:
Vehicle damage;
Theft;
Mechanical damage;
Loss of Use;
Deductibles;
Administrative Fees;
Towing, storage, or recovery costs.
WAVE Is Automatically Void If:
No police report is provided when required;
The driver was under the influence of alcohol, drugs, or controlled substances;
The vehicle was used in violation of the rental agreement or online terms;
Keys or vehicle documents are not returned.
Important Legal Notice
Any misuse, negligence, violation of the rental agreement, or failure to comply with reporting requirements voids all coverage, including CDW, TP, WAVE, and any optional protection products, and places full financial responsibility on the renter, including repairs, replacement, Loss of Use, administrative fees, towing, and related costs.
Geographical Restrictions
All rental vehicles must be operated exclusively within the State of Florida, unless prior written authorization is expressly granted by Facility Rent a Car, LLC.
Driving the vehicle outside the State of Florida without authorization is strictly prohibited and constitutes misuse of the vehicle and a material breach of the rental agreement.
Any renter who violates this restriction will be subject to:
A USD 2,000.00 unauthorized out-of-state use penalty; plus
A mileage charge of USD 0.90 per mile, calculated based on odometer readings and/or GPS or telematics data, where applicable.
These charges are in addition to any other fees, damages, Loss of Use, towing, recovery, administrative fees, or legal costs that may result from unauthorized out-of-state operation.
By accepting the vehicle, the renter authorizes Facility Rent a Car, LLC to process all related charges using the payment method on file, including after the conclusion of the rental.
Security Deposit Policy
A security deposit ranging from USD 200.00 up to USD 10,000.00 will be authorized and held on the customer’s credit card at the beginning of the rental. The exact amount is determined by the vehicle category, rental profile, and selected coverage.
The security deposit amount may be reduced depending on the insurance or protection option selected, subject to approval.
CREDIT CARD ONLY.
The security deposit must be paid using a valid credit card issued in the main driver’s name. Debit cards, cash, virtual payments, or third-party cards are not accepted for the security deposit.
The security deposit does not limit the renter’s total financial responsibility under the rental agreement and may be applied or converted into charges for any amounts due, including damages, Loss of Use, administrative fees, tolls, fines, or other authorized charges.
Subject to final inspection, audit, and claim processing, any unused portion of the security deposit will be released within approximately 30 to 45 business days after the vehicle is returned, depending on the customer’s bank or card issuer. The timing of fund availability is controlled by the issuing bank and may not be immediate.
Mileage Policy
Florida Residents
Rentals to Florida residents are subject to limited mileage, as follows:
50 miles per day, and
1,500 miles per month, whichever limit applies.
Any mileage exceeding these limits will be charged at a rate of USD 0.99 per excess mile.
Mileage is calculated based on the vehicle’s odometer readings at pickup and return. Excess mileage charges are not refundable.
Non-Florida Residents
Rentals to non-Florida residents include unlimited mileage, provided the vehicle is operated within the State of Florida, unless otherwise stated in the Rental Agreement.
Mileage may be restricted if the vehicle is operated outside Florida or if otherwise specified at the time of rental.
Important Notes
Tampering with or disconnecting the odometer constitutes misuse of the Vehicle and a material breach of the rental agreement, subject to additional charges and penalties.
Mileage charges and excess mileage fees are authorized to be processed using the payment method on file.
Out of hours fee
Normal business hours are 7:00 AM to 10:00 PM.
Vehicle returns are only permitted during normal business hours. Customers arriving before 7:00 AM or after 10:00 PM are not authorized to return vehicles and must wait until the next business day.
Any attempt to return a vehicle outside business hours, or to perform any unauthorized, unsafe, or improper procedure (including leaving the vehicle unattended, dropping keys without authorization, or abandoning the vehicle), will be considered reckless conduct and misuse of the Vehicle.
In such cases, a USD 300.00 Recklessness Fee will be charged, in addition to any other applicable charges, damages, towing, Loss of Use, or administrative fees that may result.
All charges will be processed using the payment method on file.
Tolls services
E-Toll is not mandatory; however, all rental vehicles are equipped with a SunPass / E-Toll transponder permanently affixed to the windshield. The transponder must not be removed or tampered with under any circumstances.
E-Toll Options
To avoid toll violations and penalties, the following options are available:
E-Toll / SunPass Activation:
USD 14.99 per day, plus actual toll charges.Prepaid Tolls:
USD 19.99 per day, covering toll usage during the rental period.
Declining E-Toll
If the customer declines the E-Toll / SunPass option and uses toll roads, the following will apply:
USD 25.00 administrative penalty per toll used, plus
The full cost of each unpaid toll, as assessed by the toll authority.
Tampering or Removal of Transponder
If the SunPass / E-Toll transponder is removed, damaged, covered, disabled, or tampered with in any way:
An additional penalty of USD 250.00 will be charged; and
The renter remains fully responsible for all tolls, fines, administrative fees, and related charges incurred during the rental.
Tampering with the transponder may also be considered misuse of the Vehicle and a material breach of the rental agreement.
Authorization
By accepting the Vehicle, you authorize Facility Rent a Car, LLC to process all toll-related charges, penalties, and administrative fees using the payment method on file, including after the conclusion of the rental.
Fuel policy
If fuel was not prepaid at the time of rental, the Vehicle must be returned with the same fuel level as at pickup.
If the Vehicle is returned with less fuel than originally provided, you authorize Facility Rent a Car, LLC to charge:
A USD 25.00 administrative fee; plus
USD 10.00 per gallon of missing fuel.
Fuel charges are not subject to refund and will be processed using the payment method on file.
IMPORTANT:
Returning the Vehicle with the wrong type of fuel constitutes misuse and may result in severe mechanical damage. Any damage caused by incorrect fueling (including contamination of the fuel system or engine failure) is not covered by any waiver or protection product and is the full financial responsibility of the renter, including repair or replacement costs, towing, Loss of Use, and administrative fees.

All credit cards used for rental or security deposit must be issued in the main driver’s full legal name, exactly as shown on the driver’s license.
Not Accepted for Security Deposit
The following payment methods are not accepted for the security deposit under any circumstances:
Credit cards issued in the name of anyone other than the main driver (including family members or companions);
Virtual or mobile payments, including but not limited to Apple Pay, Google Pay, Samsung Pay, or similar services;
Any debit card;
Revolut cards;
Cash.
Failure to present an eligible credit card for the security deposit may result in cancellation of the reservation without refund, in accordance with the cancellation and no-show policy.
CHARGEBACK AND DISPUTE PROHIBITION
By signing the rental agreement and/or completing a reservation, you expressly agree not to initiate, file, or pursue any chargeback, payment reversal, or payment dispute with your card issuer, bank, or payment processor for any charges that are authorized under the rental agreement and these Terms and Conditions.
This includes, but is not limited to, charges related to:
Rental fees and extensions;
Security deposits and deposit conversions;
Damage, loss, theft, or misuse of the vehicle;
Administrative fees;
Loss of Use;
Towing, recovery, storage, or impound fees;
Fines, tolls, penalties, and third-party charges;
No-show, late cancellation, or early return charges.
You acknowledge and agree that:
All charges are clearly disclosed and contractually authorized;
Initiating a chargeback in violation of this provision constitutes a material breach of the rental agreement;
Any chargeback or payment dispute filed contrary to this agreement may result in:
Immediate acceleration of all amounts due;
Additional administrative and recovery fees;
Collection actions;
Legal proceedings to recover the full amount owed, including attorneys’ fees and court costs where permitted by law.
In the event that a renter initiates a chargeback, payment dispute, reversal, or similar claim with a credit card issuer, financial institution, or payment processor regarding any charge that was authorized under the Rental Agreement, the renter agrees that Facility Rent a Car LLC shall be entitled to assess an additional administrative chargeback fee in the amount of USD $1,500.00.
This fee represents reasonable compensation for administrative time, documentation preparation, internal processing, merchant account penalties, financial institution fees, and related costs incurred in responding to and managing the chargeback or dispute process.
This charge is separate from and in addition to any underlying rental charges, damage amounts, loss of use, administrative fees, collection costs, court costs, or other amounts due under the Rental Agreement.
The renter remains contractually liable for all authorized charges regardless of any chargeback or dispute initiated with a payment processor.
Nothing in this section limits your right to dispute charges that are fraudulent, unauthorized, or not permitted by law.
Optional extras and services
ADDITIONAL DRIVERS
Additional drivers are permitted, subject to approval and applicable fees.
All additional drivers must:
Hold a valid driver’s license;
Be at least 21 years old and no older than 75 years;
Be declared and added to the rental agreement prior to operating the vehicle.
An additional daily fee applies for each additional driver.
Any person operating the vehicle who is not listed as an authorized driver will be considered an unauthorized driver, which constitutes a material breach of the rental agreement and may void coverage.
Additional Driver Fee:
USD 9.99 per day, per additional driver
AVAILABLE OPTIONAL EQUIPMENT
Optional equipment is available upon request and subject to availability. All optional equipment is rented AS IS and for an additional fee.
Baby Car Seat: USD 15.00 per day
Car Seat: USD 15.00 per day
Booster Seat: USD 6.00 per day
The renter is solely responsible for the proper inspection, installation, and use of any child safety seat. Facility Rent a Car does not provide installation assistance and makes no warranties, express or implied, regarding optional equipment.
Loss of or damage to optional equipment will result in additional charges, up to full replacement value.
Cancellation Policy
CANCELLATION POLICY
Up to 30 days prior to the scheduled pickup date:
A refund of 50% of the daily rental rate will be issued.From 29 to 15 days prior to the scheduled pickup date:
A refund of 50% of the daily rental rate will be issued as a credit for a future rental, subject to availability and rate conditions.Within 14 days prior to the scheduled pickup date:
No refunds will be issued.Promotional, discounted, or special-rate reservations are non-refundable under any circumstances.
NO REFUNDS will be issued for:
No-shows;
Early vehicle returns;
Unused rental days;
Prepaid amounts.
One Way/Drop-off Policy
One-way rentals are available by request only and are subject to approval and applicable fees.
One-way fees are non-cancellable and non-refundable once the vehicle has been picked up, regardless of changes to travel plans, early returns, or unused rental days.
All instructions regarding the authorized drop-off location and return procedures will be provided to the customer at the time of vehicle pickup.
Failure to follow the provided return instructions may result in additional charges, including recovery, towing, administrative fees, and Loss of Use.
Taxes and Additional Charges
All rentals are subject to applicable federal taxes, state taxes, local taxes, and airport-related fees, as required by law.
Such taxes and fees are not included in the quoted rental rates unless expressly stated and will be added to the total rental charges at the time of billing.
Road Assistance
Any assistance required during the rental period must be requested directly by the customer by contacting our office.
The customer must follow all instructions provided by Facility Rent a Car, LLC when requesting assistance. Failure to contact the office prior to taking any action may result in additional charges and may void any applicable coverage.
Accidents & Incidents
Mandatory Police and Facility Notification
In the event of any accident, collision, damage, theft, vandalism, or incident involving the Vehicle, the Renter must:
Contact 911 or the appropriate law enforcement authority, when required; and
Immediately notify Facility Rent a Car and follow all instructions provided.
A police report is mandatory in any case of accident, damage, theft, vandalism, or hit-and-run.
Failure to provide a police report automatically voids any coverage and places full financial responsibility on the Renter.
Duty to Report Any Damage
The Renter must notify Facility of any damage or incident, even if no accident occurred, including scratches, dents, curb damage, windshield chips, tire or wheel damage, undercarriage damage, interior damage, or mechanical issues.
Vehicle Condition Acknowledgment (Checklist Binding Effect)
The parties expressly agree that the vehicle condition checklist / inspection report completed and acknowledged by the Renter at pick-up accurately records the Vehicle’s condition at the start of the rental (“Baseline Condition”).
Any difference between the Baseline Condition and the condition of the Vehicle at return — including new damage, worsened damage, missing items, or damage discovered after return that is reasonably attributable to the rental period — shall be deemed damage occurring during the rental, and the Renter accepts responsibility.
Facility may rely on inspection reports, photographs, repair estimates, invoices, vendor documentation, and operational records to establish such damage.
DAMAGE, ACCIDENT & CLAIM-RELATED CHARGES
If the Vehicle is damaged, stolen, vandalized, or otherwise incurs loss during the rental period — whether due to an accident or not — the Renter is financially responsible for the claim, subject only to valid purchased coverage and applicable deductibles (when applicable).
IMPORTANT: Deductibles do not cover Administrative Fees or Loss of Use, which remain the Renter’s responsibility.
Damage Charge (Minimum per Item)
The Renter is responsible for the cost of repair or replacement of damaged components.
Minimum damage charge: USD 500.00 per damaged item, up to the applicable deductible limit (if any).
“Per item” may include, without limitation: bumper, door, fender, mirror, wheel, tire, windshield, seat, interior panel, undercarriage component, or electronic component.
Loss of Use (Up to 60 Days)
The Renter is responsible for Loss of Use for the period the Vehicle is unavailable due to damage, repair, replacement, investigation, recovery, or administrative processing.
Loss of Use shall be calculated as:
Average Daily Rental Rate (ADR) for the vehicle class × number of days the Vehicle is unavailable
Loss of Use is calculated without any requirement for Facility to prove actual fleet utilization or lost reservations.
The duration is determined on a case-by-case basis, limited to a maximum of 60 days.
Loss of Use applies regardless of fault and is not covered by deductibles.
Diminished Value
In addition to repair costs, the Renter is responsible for Diminished Value, meaning the reduction in the Vehicle’s market value caused by its damage history, even after repairs are completed.
Diminished Value may be determined using commercially reasonable methods, including:
Market value comparisons before and after damage;
Industry valuation tools and data;
Comparable vehicle sales with accident history;
Professional appraisals or insurer assessments.
Diminished Value is separate from repair costs and may be charged even when the Vehicle is fully repaired and operational.
Administrative Fees – Damage Claims (Minimum USD 800.00)
For any damage, theft, vandalism, or accident claim, the Renter agrees to pay a Damage Claim Administrative Fee of not less than USD 800.00.
This fee covers Facility’s administrative and operational burden, including but not limited to:
Claim intake, documentation, and evidence management;
Vehicle inspection, photography, estimates, and reporting;
Coordination with repair shops, towing companies, insurers, and vendors;
Vehicle logistics, downtime management, and operational disruption;
Staff time, accounting, payment processing, and record preparation;
Preparation for insurance submissions, arbitration, or court proceedings.
This fee is separate from and in addition to all other charges and is not covered by deductibles.
Tow, Impound & Vehicle Recovery (Additional Admin Fee)
If the Vehicle is towed, impounded, seized, or held by a tow yard for any reason during the rental period, the Renter is responsible for:
All towing, impound, storage, release, and related charges; and
An additional Vehicle Recovery Administrative Fee of USD 800.00, which applies independently of and in addition to the Damage Claim Administrative Fee in Section 19.4.
Legal, Storage, and Recovery Costs
The Renter is responsible for all costs incurred by Facility related to:
Towing, storage, recovery, and transport;
Court costs, penalties, and compliance expenses arising from Vehicle use;
Reasonable attorneys’ fees and collection costs, where permitted by law.
Final Balance & Renter Responsibility
Facility will calculate the final claim amount based on documented costs.
The Renter is responsible for payment of all validated charges minus any amounts paid by applicable coverage, subject to deductibles (when applicable).
The Renter expressly agrees that:
Deductibles do not apply to Administrative Fees or Loss of Use; and
Any violation of the Terms voids coverage.
Automatic Termination After Accident or Vandalism
In the event of accident, vandalism, or natural damage, Facility may automatically terminate the rental, and the Renter must return the Vehicle immediately as instructed.
MECHANICAL DAMAGE (ENGINE, TRANSMISSION, DRIVETRAIN & RELATED SYSTEMS)
Definition of Mechanical Damage
For purposes of this Agreement, Mechanical Damage includes, but is not limited to, any damage, failure, malfunction, or abnormal condition affecting the engine, transmission, drivetrain, differential, suspension, steering system, cooling system, lubrication system, fuel system, exhaust system, electronic control modules (ECUs), sensors, actuators, or any other mechanical, electrical, or electromechanical component of the Vehicle.
Mechanical Damage may result from accident-related events or from improper operation, misuse, or negligence during the rental period.
Repair Standard – Replacement, Not Temporary Repair
In the event of Mechanical Damage occurring during the rental period, the Vehicle shall be restored by replacement of all affected parts, assemblies, or components, as determined necessary to return the Vehicle to a safe, reliable, and commercially acceptable operating condition.
The Renter expressly agrees that:
Facility is not required to perform temporary, partial, or cosmetic repairs;
Facility may elect, at its sole discretion, to replace damaged components with new, remanufactured, or manufacturer-approved parts; and
Decisions regarding repair method and scope are made to ensure safety, reliability, and fleet integrity, not merely minimum functionality.
Renter’s Financial Responsibility for Mechanical Damage
The Renter is responsible for the full cost of Mechanical Damage, including but not limited to:
Parts and components;
Labor;
Diagnostic procedures and inspections;
Programming, calibration, relearning, or software updates;
Fluids, consumables, and related materials.
Such responsibility applies in addition to all other applicable charges under these Terms, including:
Damage charges;
Loss of Use;
Diminished Value (when applicable);
Administrative Fees;
Towing, storage, impound, and recovery costs.
Professional Evaluation and Determination of Costs
The existence, cause, and scope of Mechanical Damage, as well as the appropriate repair method and cost, shall be determined by a qualified, licensed, and/or certified professional, including but not limited to:
ASE-certified technicians;
Manufacturer-authorized repair facilities;
Licensed mechanical inspectors;
Independent professional evaluators.
The Renter agrees that any written estimate, diagnostic report, assessment, or valuation issued by such professional constitutes a commercially reasonable and sufficient basis for determining the amount owed.
Payment Obligation Independent of Repair Completion (Florida Law)
The Renter expressly acknowledges and agrees that, under Florida law, compensation for damage to personal property is owed at the time the damage occurs and is not conditioned upon the owner having already completed the repair.
Accordingly:
The amount owed by the Renter shall be based on the professionally determined cost of repair or replacement; and
The Renter’s obligation to pay is not dependent on Facility having already performed, completed, or paid for the repair at the time of billing, claim presentation, or court proceedings.
Payment is due for the cost necessary to repair or replace the damage, regardless of whether Facility elects to repair the Vehicle immediately, at a later time, or through a third party.
Mechanical Damage Resulting from Accidents
Mechanical Damage resulting directly from a reported accident, supported by a valid police report and full compliance with these Terms, may be processed under any applicable insurance or protection product only to the extent expressly covered, and subject to:
Deductibles;
Exclusions;
Limitations set forth in these Terms and in the selected coverage.
Unless expressly stated otherwise in writing:
Administrative Fees,
Loss of Use, and
Towing, storage, and recovery costs
remain the Renter’s responsibility.
Mechanical Damage Caused by Misuse or Negligence
Mechanical Damage caused by misuse, negligence, or improper operation of the Vehicle is not covered by any insurance, waiver, or protection product, including but not limited to:
Continuing to operate the Vehicle after mechanical warning lights, alerts, or messages appear;
Overheating due to continued operation after temperature warnings;
Operating the Vehicle with insufficient oil, coolant, or other required fluids;
Improper fueling or contamination of fuel systems;
Ignoring abnormal noises, vibrations, leaks, or performance issues;
Operating the Vehicle in a manner inconsistent with manufacturer recommendations or intended use.
In such cases, the Renter is 100% financially responsible for:
All mechanical repair and replacement costs;
All towing, storage, impound, and recovery expenses;
All Administrative Fees;
All Loss of Use charges;
Any additional costs arising from immobilization, secondary damage, or operational disruption.
No Limitation by Deductibles
Deductibles, when applicable, do not apply to:
Administrative Fees;
Loss of Use;
Mechanical Damage caused by misuse, negligence, or improper operation.
Survival of Obligations
The Renter’s obligations under this Mechanical Damage section survive the termination of the rental period and remain fully enforceable until all amounts owed are paid in full.
General Conditions
VEHICLE CONDITION ACKNOWLEDGMENT
The parties expressly agree that the vehicle condition checklist / inspection report completed and acknowledged by the Renter at pick-up accurately records the Vehicle’s condition at the start of the rental (“Baseline Condition”).
Any difference between the Baseline Condition and the condition of the Vehicle at return — including new damage, worsened damage, missing items, or damage discovered after return that is reasonably attributable to the rental period — shall be deemed damage occurring during the rental, and the Renter accepts responsibility.
Facility may rely on inspection reports, photographs, repair estimates, invoices, vendor documentation, and operational records to establish such damage.
RESPONSIBILITY FOR RESERVATIONS MADE THROUGH THIRD-PARTY PORTALS AND TRAVEL AGENCIES
(Decolar, Despegar, Rentalcars, Rentcars, Booking, Expedia, and similar platforms)
Reservations made through third-party portals or travel agencies are subject to both:
The voucher or confirmation issued by the third-party platform; and
Facility Rent a Car’s Terms and Conditions, which govern vehicle use, responsibility, and liability.
Compliance with this Agreement is mandatory and is not waived, replaced, or limited by any third-party description, website content, or customer service representation.
With respect to security deposits, insurance or protection products, toll device activation, optional services, and ancillary charges, the conditions described in the third-party voucher apply only to the extent they do not conflict with this Agreement.
Any procedures, promises, or representations made by third-party platforms that are inconsistent with these Terms shall be null and void.
If the reservation is made under minimum coverage allowed for transit, any security deposit collected may be retained in full in the event of accident or damage, regardless of the extent or monetary value of the damage, to the fullest extent permitted by law.
CHARGES AND COSTS
You agree to pay Facility Rent a Car, LLC, at or before the conclusion of the rental or upon demand, all charges, fees, and costs due under this Agreement, including but not limited to:
Mileage charges if the odometer is altered, tampered with, or rendered unreliable;
Taxes, surcharges, tolls, fines, penalties, and government-imposed fees related to the rental or use of the Vehicle;
Vehicle recovery costs, including locating, towing, storage, impound, and repossession if:
The Vehicle is not returned;
The Vehicle is returned to an unauthorized location; or
Facility elects to repossess the Vehicle;
Collection and enforcement costs, including pre- and post-judgment attorneys’ fees, court costs, and collection agency fees, where permitted by law;
Cleaning fee up to USD 250.00 if the Vehicle is returned substantially less clean than when rented;
Smoking or vaping fee of not less than USD 450.00 if evidence of smoking or e-cigarette use is found;
Lost or damaged keys, key fobs, tags, plates, or vehicle documents:
Administrative fee of up to USD 800.00, plus all actual replacement, programming, towing, and Loss of Use costs;Improper transport fee up to USD 250.00 for transporting luggage on seats or animals in the Vehicle, except for legally recognized service or support animals;
Towing, impound, storage, forfeiture, court costs, and related expenses arising from Vehicle use;
Late return charges:
Special rates, complimentary upgrades, or free equipment apply only to the original rental period. Late returns may be charged at the standard daily rate, which may be substantially higher;No refunds for prepaid amounts if the Vehicle is returned before the agreed Delivery Date;
Final audit authorization:
You authorize correction and processing of any adjusted charges to your payment method on file;Delay / No-Show policy:
A fee of up to 30% of the total contract value may be charged if the rental is canceled due to delay. After a 29-minute grace period, the reservation is deemed a NO SHOW and no amounts paid will be refunded;Minimum damage charge:
USD 500.00 per damaged item, up to the applicable deductible (if any), except where coverage eliminates the deductible.
TOLLS, FINES, AND VIOLATIONS
You are responsible for direct payment of all tolls, parking fines, toll evasion penalties, citations, and other fees incurred during the rental.
If Facility pays any such amount on your behalf, you agree to reimburse the full amount plus:
USD 50.00 administrative fee per fine, and
USD 25.00 administrative fee per toll if toll services were not contracted.
OPTIONAL EQUIPMENT
Optional equipment (including child seats and GPS units) is provided AS IS, subject to availability, and for an additional fee.
Optional equipment is not part of the Vehicle. You are fully responsible for any loss or damage to such equipment, regardless of cause, and regardless of whether CDW or other protection was purchased.
You are solely responsible for inspecting, installing, and using child seats. Facility makes no warranties, express or implied, regarding optional equipment, including merchantability or fitness for a particular purpose.
Lost or damaged GPS units or accessories will be charged at fair market replacement value.

Litigation Administrative Recovery Fee
If any dispute, damage claim, unpaid balance, or contractual obligation is not resolved administratively and requires referral to court proceedings, legal filing, or formal collection action, the renter agrees that Facility Rent a Car LLC shall be entitled to assess an additional administrative litigation recovery fee in the amount of USD $1,000.00.
This fee represents reasonable compensation for internal administrative time, claim preparation, document compilation, court filing coordination, attendance preparation, case management, and related operational expenses incurred as a result of the renter’s failure to resolve the matter prior to escalation.
This fee is separate from and in addition to:
Repair costs
Administrative fees
Loss of use
Diminished value
Chargeback-related costs
Court filing fees
Service of process fees
Statutory interest
Attorney’s fees (if applicable under law or contract)
The renter remains contractually responsible for all amounts due under the Rental Agreement regardless of whether the matter proceeds to court.
